Transforming Long Term Supports and Services System - Public Forums, video and other info.

Over the past decade, the Department of Health and Hospitals has engaged stakeholders in a comprehensive effort to reform long-term support and services (LTSS) by striking the appropriate balance between providing care in institutional and community settings, improving quality of care, expanding service options, and addressing financial sustainability. In December 2012, DHH issued a Request for Information seeking creative, innovative and viable strategies to move forward with its next phase of delivering coordinated care through the creation of a new managed long-term supports and services (MLTSS) program. On Friday, August 30, 2013, DHH published its initial concept paper outlining the principles and foundation of the LTSS transformation and to provide a framework for ongoing stakeholder feedback and engagement.

There are three webinars scheduled to give the public an opportunity to ask questions and provide feedback to the Department on MLTSS. Prior to the webinars, the access information will be posted here. The webinars will begin with a brief presentation by Secretary Kliebert, followed by 90 minutes of questions from the public.

Public Forum Meetings

IDEA Regulations Changes Concerning Parental Notification of Access to Benefits

 

The regulation governing school districts’ ability to bill Medicaid for related services under IDEA has changed. According to the video posted by Pete Wright of Wrightslaw, there is a possible unintended consequence of this change in that ...it may be easier for school district personnel to make mistakes or intentionally submit fraudulent claims to Medicaid.

FROM THE US DOE GUIDANCE DOCUMENT:
The prior regulations required the public agency responsible for providing a free appropriate public education to a child with a disability under the IDEA to obtain parental consent each time access to public benefits or insurance (e.g., Medicaid) was sought.

The new regulations have two basic requirements. First, the public agency must notify parents in writing of a number of safeguards to protect their rights before the public agency accesses the child’s or parent’s public benefits or insurance to pay for services under the IDEA for the first time and annually thereafter.

Second, the public agency must obtain a one-time written consent from the parent that meets the requirements of 34 CFR §99.30 and §300.622, and also specifies that the parent understands and agrees that the public agency may access the child’s or parent’s public benefits or insurance to pay for special education or related services under part 300 (services under the IDEA). 34 CFR §300.154(d)(2)(iv).

Yesterday, the Subcommittee on the Constitution of the House Judiciary Committee held a hearing on H.R. 3356, the "ACCESS (ADA Compliance for Customer Entry to Stores and Services) Act," which is the latest version of the oft-proposed ADA Notification Act. The bill's sponsor, Rep. Lungren, testified, as did business owner Lee Ky, disability rights lawyer Andy Levy, and defense lawyer David Warren Peters.
